Legal norms for the use of live traps
The problem with wild animals affects many farms, pens or houses. Pests such as martens, foxes, otters, ravens or hawks in search of food venture far into human habitation, causing very large losses in property and livestock. One of the best and proven ways to combat pests is to use lived traps. They allow you to quickly and effectively catch various types of aggressive animals that appear in our environment.
Detailed regulations and rules related to the use of live traps or other methods of capturing wild animals are regulated by the laws and regulations listed below:
Most species of birds and wild animals occurring in Poland are covered by legal protection under the Regulation of the Minister of the Environment of 12 October 2011 on animal species protection (Journal of Laws No. 237, item 1419) , in relation to which, in accordance with §7 of the above-mentioned regulation, a number of prohibitions apply, including the prohibition of intentional mutilation and capture specified in point 2.
Pursuant to Article 56(2)(2) and (4) in conjunction with Article 52(1)(2) of the Nature Conservation Act (Journal of Laws of 2013, item 627, as amended), the regional director of environmental protection in the area of his activity may allow the capture of wild animals under species protection. Such a permit may be issued in the absence of alternative solutions, if they are not harmful to the maintenance of wild populations of protected animal species in a favourable conservation status and if one of the conditions set out in Article 56(4)(1) to (7) of the Act of 16 April 2004 on Nature Protection is met.
In addition, in accordance with Article 131(14) of the Act of 16 April 2004 on nature protection, anyone who violates the prohibitions in relation to animals covered by species protection without a permit is subject to arrest or a fine.
In accordance with the applicable law, wild animals are subject to species protection, which is aimed at protecting the natural habitats and populations of these species. To this end, a number of legal regulations and norms have been created that are aimed at taking care of animal welfare and introduce prohibitions on intentional and deliberate capture, mutilation, injury or harm of wild animal species. It also involves the use of traps, which must meet certain standards and can only be used in certain cases and after obtaining the appropriate authorization. Therefore each of our vital traps is thoroughly checked for safety so that they do NOT harm the animals caught in any way. Thanks to this, in a humane way and without prejudice to wild animals, they can be caught and then resettled in a new environment, where the predator will not threaten people or farm animals.
It should be remembered that all activities related to the capture of wild predators and pests using live traps or bird traps should be carried out only with the consent and under the supervision of appropriate administrative bodies, i.e. e.g. the regional director of environmental protection. Permission to use the frogs may be granted only when all other possibilities for eradicating the pest have been exhausted.
